Y560 a new battery issue

I have a fairly new (purchased Jan this year) Y560 and and am having battery issues. I have set it to "maximise battery life" so it usually runs on mains at an 80% charge.

When I unplug it shows typically it will run for 2h+ and seems OK until I hibernate it - then when I restart it usually runs for a couple of minutes, flashes up a low battery warning and then immediately dies without even hibernating properly.

It's a bit of a hassle to return to the place I bought it from so wonder if anyone else has had any similar issues?
