Should I sent in my new T430 to Lenovo?

I just got my new Thinkpad T430. It comes with i5 and the Nvidia GPU. 

When I am working in a quiet area, I can hear the fan constantly on and making "hummmmmmm" sounds. Is this a defect?

What kind of load are you putting on the system?

 

Is it a constant low hum or does it oscillate?

I have been installing windows update and using the web. It's a constant fan sound, not too loud but definately distracting when I am sitting in the library.

I used the TP fan control to check BIOS fan mode, right now it's at 54 degree Celcius with 1 CPU and the fan speed is 3785 RPM.

I use tpfc in the smart mode and it's super quiet.
